How close can you build a swimming pool to your house?
For any areas that are more than 20m from the house, only 10sq m can contain any type of structure, including a pool, under permitted development rules. In addition, the pool – or any other structure – has to be behind the line of the back of the house, not to the side of the house.
So, a pool deck cannot go on an easement, but it can be adjacent to one in most cases. Usually, there are no distance requirements for an easement, but you should always check with your municipality's building inspector.
They must be positioned at least 1000mm away from the water's edge (so a child cannot fall off the boundary fence and into the pool).
Most people need between 600 and 900 square ft. of patio around a pool. That's enough room for a table and chair set, some chaise lounges, and a comfortable walking space around the perimeter of the pool. Consolidate most of the patio in 1 or 2 areas, rather than distributing it evenly around the pool.
Permission of local authority is required for construction of any type of facility. In case the area is falling under the jurisdiction of the local Panchayat, then its permission may be required. Also an application may be submitted to the District Magistrate for permission to construct and operate the swimming pool.
Planning permission is not usually required to install an outdoor domestic swimming pool as a pool is often considered as a garden project.
A good rule to follow is to place the pool at least 1,000 millimetres from the boundary line, and the landscape between the boundary line and the pool to enhance the overall appearance of the space. Ultimately, you'll be spending more time enjoying the view of your pool than swimming in it.
Allowing your neighbors to swim in your pool can be a slippery slope. You may want to consider setting clear and strict boundaries with your neighbor, especially if you don't know them very well. What is this? If they ask politely to use your pool while you are home, you can let them.
There are basically three kinds of non-express easements created by operation of law. The first is “prescriptive easements", the second is “implied easements” and the third is “easements by estoppel”.
National Requirements
National building codes, as outlined by the National Fire Protection Association (NFPA), require an outdoor aboveground pool to be at least 10 feet away from the walls of a house. This helps ensure that leaking or splashed water cannot contact any electrical wiring and cause a short.
